If you are accepting these Terms and using the Services on behalf of a company, organization, government, or other legal entity, you represent and warrant that you are authorized to do so. You may use the Services only in compliance with these Terms and all applicable local, state, national, and international laws, rules and regulations.
The Services that Jobskar provides are always evolving and the form and nature of the Services that Jobskar provides may change from time to time without prior notice to you. In addition, Jobskar may stop (permanently or temporarily) providing the Services (or any features within the Services) to you or to users generally and may not be able to provide you with prior notice. We also retain the right to create limits on use and storage at our sole discretion at any time without prior notice to you.
The Services may include advertisements, which may be targeted to the Content or information on the Services, queries made through the Services, or other information. The types and extent of advertising by Jobskar on the Services are subject to change. User certifies to Jobskar that if User is an individual (i.e., not a corporate entity), User is at least 13 years of age. No one under the age of 13 may provide any personal information to or on Jobskar (including, for example, a name, address, telephone number or email address). User also certifies that it is legally permitted to use the Services and access the Site, and takes full responsibility for the selection and use of the Services and access of the Site. This Agreement is void where prohibited by law, and the right to access the Site is revoked in such jurisdictions. Under no circumstances will User use the Site or the Service to (a) send unsolicited e-mails, bulk mail, spam or other materials to users of the Site or any other individual, (b) harass, threaten, stalk or abuse any person or party, including other users of the Site, (c) create a false identity or to impersonate another person, or (d) post any false, inaccurate or incomplete material or delete or revise any material that was not posted by You.
Abuse and Spam Jobskar strives to protect its users from abuse and spam. User abuse and technical abuse are not tolerated on Jobskar.com, and may result in permanent suspension. Any accounts engaging in the activities specified below may be subject to permanent suspension.
Targeted Abuse: You may not engage in targeted abuse or harassment. Some of the factors that we take into account when determining what conduct is considered to be targeted abuse or harassment are: if you are sending messages to a user from multiple accounts; if the sole purpose of your account is to send abusive messages to others; if the reported behavior is one-sided or includes threats
Spam: You may not use the Jobskar service for the purpose of spamming anyone. What constitutes “spamming” will evolve as we respond to new tricks and tactics by spammers. Some of the factors that we take into account when determining what conduct is considered to be spamming are:
Pornography: You may not use obscene or pornographic images in either your profile photo, header photo, or user background.
Malware/Phishing: You may not publish or link to malicious content intended to damage or disrupt another user’s browser or computer or to compromise a user’s privacy.
Your account may be suspended for Terms of Service violations if any of the above is true.

The word “Content” stands for including but not limited to TEXTS, IMAGES, PHOTOGRAPHS, VIDEOS, INFORMATION OF ANY KIND.

Jobskar reserves the right and sole discretion to refuse access to the Platform, terminate any account, remove or restrict any content, at any time, with or without notice to you in case we notice any illegal activity on or from account or if we have reason to believe that any information provided by you is untrue, inaccurate, outdated or incomplete.
Jobskar respects the intellectual property of others and takes the protection of copyrights and all other intellectual property very seriously, and we ask our users to do the same. Infringing activity will not be tolerated on or through the Services.
Jobskar’s intellectual property policy is to (a) remove material that Jobskar believes in good faith, upon notice from an intellectual property owner or their agent, is infringing the intellectual property of a third party by being made available through the Services, and (b) remove any User Content posted to the Services by “repeat infringers.” Jobskar considers a “repeat infringer” to be any user that has uploaded User Content to the Services and for whom Jobskar has received more than two takedown notices complaint (c) with respect to such User Content, Jobskar has discretion, however, to terminate the account of any user after receipt of a single notification of claimed infringement or upon Jobskar’s own determination.
If you receive a notification from Jobskar that material made available by you on or through the Services has been the subject of a Notification of Claimed Infringement, then you will have the right to provide Jobskar with what is called a “Counter Notification.” To be effective, a Counter Notification must be in writing, provided to Jobskar’s Designated Agent through one of the methods identified immediately above, and include substantially the following information:
Upon receipt of a Counter Notification, Jobskar shall promptly provide the party submitting a Notification of Claimed Infringement with a copy of the Counter Notification, and Jobskar will replace the removed material or cease disabling access to it in not less than 14, nor more than 20, business days following receipt of the Counter Notice, unless Jobskar’s Designated Agent first receives notice from the person who submitted the Notification of Claimed Infringement that such person has filed an action seeking a court order to restrain the user from engaging in infringing activity relating to the material on Jobskar's system or network.
False Notifications of Claimed Infringement or Counter Notifications
Any person who knowingly materially misrepresents under Section 512 of the Copyright Act that material or activity is infringing, or that material or activity was removed or disabled by mistake or misidentification, shall be liable for any damages, including costs and attorneys’ fees, incurred by the alleged infringer, by any copyright owner or copyright owner’s authorized licensee, or by a service provider, who is injured by such misrepresentation, as the result of [Jobskar] relying upon such misrepresentation in removing or disabling access to the material or activity claimed to be infringing, or in replacing the removed material or ceasing to disable access to it.
This Agreement (and any further rules, polices, or guidelines incorporated by reference) shall be governed and construed in accordance with the laws of INDIA, without giving effect to any principles of conflicts of law.
Cancellations: As a general rule, all sales made on Jobskar are final and you shall not be entitled to cancel your order once you have received confirmation of the same. Jobskar reserves the sole right to cancel any order as per our discretion in case (i) we are unable to deliver the order in a satisfactory manner and/ or (ii) the user tries to take advantage of the system which violates the Terms of Use. Jobskar will ensure that any communication of cancellation of an order or any applicable refund will be made within a reasonable period of time.
Refunds: You shall be entitled to a refund only if Jobskar is unable to deliver your order. For refund requests please email to [email protected] within 1 week of the date of purchase. All refunds will be processed on a prorated basis, depending on the service already delivered by Jobskar. Refunds will be done directly to the original payment mode within seven working days of finalization of the claim.
This Platform may run advertisements and promotions from third parties, products and/or services in any manner and to any extent. Your communications, activities, relationships and business dealings with any third parties advertising or promoting via the Platform, including payment and delivery of related goods or services, and any other terms, conditions, warranties or representations associated with such dealings, shall be solely matters between you and such third parties.
You acknowledge and agree that Jobskar is not responsible or liable for any loss or damage of any kind incurred as a result of any such dealings or as the result of the presence of such non-Jobskar advertisers on the Platform.
Our links with advertisers should not be construed as an endorsement, approval or recommendation by us of the owners or operators of those linked websites, or of any information, graphics, materials, products or services referred to or contained on those linked websites, unless and to the extent stipulated to the contrary.
We may terminate your access to the Site, without cause or notice, which may result in the forfeiture and destruction of all information associated with you. All provisions of this Agreement that by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
Our Site may contain links to third-party sites that are not owned or controlled by us. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third party sites or services. We strongly advise you to read the terms and conditions and privacy policy of any third-party site that you visit.
We reserve the right, at our sole discretion, to modify or replace these Terms and Conditions by posting the updated terms on the Site. Your continued use of the Site after any such changes constitutes your acceptance of the new Terms and Conditions.
